Terms of Service

1. Acceptance of terms

By accessing or using TaxStrategyHQ (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of service

TaxStrategyHQ is a matching service that connects US consumers with vetted independent third-party tax resolution firms. We are not a tax preparer, tax resolution firm, accounting firm, law firm, financial advisor, or government agency.

3. Disclaimers

Please read carefully.

  1. Not a tax/legal/financial advisor. TaxStrategyHQ does not provide tax, legal, accounting, or financial advice. Any content on this site is for general informational purposes only and should not be relied upon as professional advice.
  2. No IRS affiliation. TaxStrategyHQ is not affiliated with, endorsed by, or sponsored by the Internal Revenue Service or any other government agency. References to IRS programs (Offer in Compromise, Installment Agreement, Penalty Abatement, Currently Not Collectible) are for educational purposes; eligibility for any IRS program is determined solely by the IRS.
  3. Results vary. Outcomes from tax resolution depend entirely on individual facts, IRS determination, and the actions of the matched firm. Past results are not indicative of future outcomes. No specific result or savings amount is promised or guaranteed.
  4. No guarantee of match outcome. While we vet the firms in our network, we do not guarantee any particular outcome from your interaction with a matched firm. You are not required to engage the matched firm and may seek alternative representation at any time.
  5. Third-party relationships. Matched tax resolution firms are independent third parties, not employees or agents of TaxStrategyHQ. Their recommendations, fees, conduct, and outcomes are their own responsibility, not ours.
  6. Information only. The eligibility check provides a directional score, not a determination of eligibility for any IRS program. Only a licensed tax professional can determine your actual eligibility.

4. Eligibility

You must be 18 or older and a US resident to use the Service. We currently do not match California residents with tax resolution partner firms and do not collect contact information from consumers who indicate California residency. This exclusion reflects regulatory considerations under the California Department of Financial Protection and Innovation (DFPI) and the California Consumer Financial Protection Law (CCFPL).

5. User responsibilities

You agree to provide accurate information, not to misuse the Service, and not to use it for any unlawful purpose. You agree to comply with all applicable laws.

6. Intellectual property

The TaxStrategyHQ name, logo, and site content are our property. You may not use them without our written permission.

7. Third-party services

Matched tax resolution firms are independent third parties. Your engagement with any matched firm is entirely between you and that firm. We are not responsible for their conduct, fees, results, or any disputes arising from your engagement with them.

8. Limitation of liability

To the maximum extent permitted by law:

  1. TaxStrategyHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
  2. TaxStrategyHQ shall not be liable for any conduct, fees, recommendations, advice, errors, or outcomes of the matched tax resolution firm.
  3. Our total cumulative liability to you for any claim arising out of or related to the Service shall not exceed one hundred dollars ($100) or the amount you paid us (which for most users is zero), whichever is greater.
  4. Nothing in this section limits liability where prohibited by applicable law.
  5. Nothing in this section limits or excludes liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be limited under applicable law.

9. Indemnification

You agree to indemnify and hold harmless TaxStrategyHQ from any claims arising from your misuse of the Service, violation of these Terms, or violation of any rights of a third party.

10. Dispute resolution and binding arbitration

10.1. Mandatory arbitration. Except as set forth in Section 10.4 (small claims) and Section 10.5 (opt-out), any dispute, claim, or controversy arising out of or related to these Terms or the Service shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect.

10.2. Seat and venue. The arbitration shall be seated in Arizona and conducted in English. Any in-person hearing, if required, shall be held in the county where you reside or in Maricopa County, Arizona at your election.

10.3. Fees. TaxStrategyHQ will pay all AAA filing, administrative, and arbitrator fees in excess of two hundred dollars ($200) for any consumer-initiated arbitration, provided the claim is not frivolous. Each party otherwise bears its own attorneys' fees and costs, except as required by law or awarded by the arbitrator.

10.4. Small claims carve-out. Either party may bring an individual action in small claims court for any claim within that court's monetary and subject-matter jurisdiction under the law of your state of residence.

10.5. 30-day opt-out. You may opt out of this arbitration agreement by sending written notice to TaxStrategyHQ at [email protected] or by US mail to TaxStrategyHQ, 7349 N Via Paseo Del Sur, Ste 198, Scottsdale, AZ 85258, within 30 days of first accepting these Terms. Your opt-out notice must include your full name, the email and phone you used on our eligibility check, and a clear statement that you opt out of arbitration. Opting out does not affect any other provision of these Terms.

10.6. Class action waiver. To the maximum extent permitted by law, all claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate claims or preside over any form of class proceeding. If this Section 10.6 is found unenforceable, then the entirety of Section 10 shall be null and void, and the dispute shall proceed in court.

10.7. Survival. This Section 10 survives termination of these Terms and your use of the Service.

11. Modifications

We may modify these Terms from time to time. The current version is always at this URL. Continued use of the Service after changes constitutes acceptance.
